Fugitive shot during failed arrest files case against police

A fugitive shot by police in January during a failed traffic stop and arrest has filed a report against the officer, his attorney told broadcaster AT5. Luciano D. was shot in the arm by police as he drove off when police ordered him out of a car at a busy intersection in Amsterdam West. The 18-year-old’s attorney, Chrissy Stroobach, said police acted disproportionately in firing shots at the car as it pulled away on January 21. One bullet struck his right arm near his elbow. “I think you can question whether the officer was allowed to shoot at all,” Stroobach said. “If he had been allowed to shoot, then it could have been done any other way,” she said, suggesting shooting out the tires, or firing another warning shot. At least one officer fired six shots during the stop. Three were warning shots when he ordered all of the car’s occupants out of the vehicle, and three more as the car drove away. He was eventually arrested by a SWAT team on the 23rd. Luciano D. was temporarily released from a Lelystad youth detention facility to attend a funeral on December 31, but he did not return to the correctional institution as instructed. Police put out a bulletin for the fugitive on January 4, stating that he could be carrying a firearm. “He has many regrets,” his attorney said. “And at some point, he realized himself that of course he had to go back,” she continued. “But then the decision to return, for such a young boy of only 18, is much harder.” After the arrest, police said D. is on the Top 600 list of criminals in Amsterdam.
