State Secretary Fred Teeven and the Ministry of Justice have been determined too strict in their policy around the child pardon regulations. The court in The Hague decided yesterday that it is unjust to deny a child asylum if the child has not been visible to the Realm, but only to the municipality.

All the 100 children who are now in danger of falling outside the child asylum law, will be allowed to stay in the Netherlands. The current demands for the child pardon are not going to be amended in future, however, as this would cause more borderline cases to arise.

There is growing resistance against the manner in which the cabinet is carrying out the child pardon rule. Child ombudsman Marc Dullaert is taking a step towards the protesters, aligning himself with people's rights organizations and increasingly more mayors who are critical about the rule.

The so-called 'child pardon' has given 675 young asylum seekers residence permits. This regulation also allows 775 family members to stay in The Netherlands. This is stated in the yearly report from the Immigration and Naturalization Service, which Trouw has access to.
