Five suspects in fatal case on Mallorca sued in court for damages
Five of the seven suspects in the Mallorca case, which involved the death of 27-year-old Carlo Heuvelman, are appealing against the ruling of the Court of Appeals. They do not agree with the amount of damages they have to pay. Anis Boumanjal, Sanil B.'s lawyer, confirmed reports from RTL Boulevard.
RTL Boulevard reported that Carlo's girlfriend was awarded damages of 218,057 euros, which the five must pay. According to Boumanjal, however, there is "no legal basis" for the judgment. In an interview with RTL Boulevard, he said that there was "something legally wrong" with the fact that "she was dependent on his income."
The lawyer of one of the other defendants in the case, Daniel Fontijn, told the editors of the television program that the girlfriend was not registered with Carlo and that they were not fiscal partners. Therefore, he wants the Supreme Court to re-examine "this whole damage story."
The lawyer for Carlo's girlfriend, Edwin Bosch, regrets the move by the five but is confident that the damages will stand. “It was never about the money for Lisa. However, she believes that the court made a very clear decision regarding compensation. The court ruled that the suspects must compensate the damage caused by Carlo's death, which still felt somewhat like justice. Now the suspects are also trying to avoid payment of the compensation. We have every confidence that the conviction will be upheld," he told RTL Boulevard.
27-year-old Carlo died in the summer of 2021 on the Spanish island of Mallorca due to extreme nightlife violence. He was beaten on the boulevard of the seaside resort of El Arenal and succumbed to brain damage four days later in hospital. His friends were also abused, as were men from another group of friends.
Earlier this year, Sanil B. was acquitted of manslaughter of Heuvelman on appeal due to insufficient legal and convincing evidence. He was sentenced to 32 months in prison, of which three months were conditional, for two attempts at manslaughter and public violence. He had already served that sentence in pre-trial detention at the time of the verdict.
The court imposed prison sentences on the co-suspects ranging from fifteen months to 110 hours of community service.
