Two days in jail for man convicted of anal sex with 13-year-old

On Thursday the court in Arnhem sentenced a 35 year old man to 182 days in prison, 180 of which conditionally suspended, for having oral and anal sex with a 13 year old boy in February last year. The judge found that the victim had played "an inviting role" in his abuse. The 35 year old man had already spent two days in custody, so is free to go. The man was also sentenced to 240 hours of community service and a probation period of three years. During this period the man has to report to the probation service and receive outpatient treatment. The suspect was found guilty based on the victim's statements and Whatsapp messages between the victim and the suspect, according to the court statement. The court did take into account that in one of the Whatsapp messages the boy describes the "acts" as scary. The suspect replied that it was experience building. The Public Prosecutor had demanded a 24 month prison sentence, 12 of which conditionally suspended, against the man. The court decided not to impose a longer imprisonment on the man because "the fact dates back over 1.5 years ago, it stayed at one time, the victim played an inviting role, he was not forced and the suspect has no previous convictions for committing an offense". The boy asked for damages of 15,500 euros. The court granted him 1,800 euros in damages.
