Prosecutor seeks 3 years for man accused of fatal oral sex assault on intoxicated woman

The Public Prosecution Service (OM) recommended 3 years in prison against 31-year-old Sebastiën van de B. on Thursday in the court in Alkmaar. Prosecutors think that Van de B. caused the death of a woman by choking her with his penis while she was performing oral sex. The victim was extremely intoxicated at the time.

The events took place on August 12, 2022, in the suspect’s home in the village of Burgerbrug in Noord-Holland. The victim, who prosecutors described as a “young, vulnerable girl,” was living with the suspect.

Van de B. called the emergency number 112 when he realized that the woman was not breathing. He allegedly told police that she stopped breathing during oral sex. The man now has no recollection of this and claims that the death did not come as a result of oral sex.

The victim died two days after the incident in the hospital, after life support was withdrawn in consultation with the woman’s family.

The suspect recorded videos on his phone that evening and sent them to others via Snapchat. Two of these videos were shown during the hearing. The videos show Van der B. and the victim having a fully chaotic evening involving a lot of alcohol, which was later described by the suspect as an “erotic evening.”

The videos include footage of Van de B. frequently talking about oral sex in crude terms. The victim can be seen, among other things, vomiting or unconscious on the couch.

According to the OM, the footage provides enough evidence for the formal charge: sexual penetration of a person in a state of unconsciousness, resulting in death.

The police confiscated the victim’s iPhone when Van de B. was arrested. It has been found that she made a several-hour-long audio recording that evening, but according to the Public Prosecution Service (OM), they have so far been unable to unlock the device due to an untraceable Apple ID.

The victim lost her mother when she was six years old and her father a year and a half later. An aunt spoke on behalf of the family in court, describing the relationship between the suspect and the victim as "very unhealthy and unsafe."

The court will deliver its verdict on July 24.
