Dutch court orders Apple to replace defected iPhones with new ones

The court in Amsterdam ruled on Tuesday that Apple has to replace a defective iPhone that is still in its warranty period with a new one. A refurbished copy is not good enough, NU.nl reports. This lawsuit was filed against Apple by Kim van de Scheur. Apple was unable to fix her faulty iPhone and offered to replace it with a refurbished unit - one made of recovered parts from other iPhones. Van der Scheur refused this offer because her phone was still brand new. She told NU.nl that Apple also offered her 45 euros in accessories, but she still did not find it good enough and turned to court. The court ruled that it can not be that a 799 euro iPhone is irreparably defective after only eight months, so the client can call upon the warranty and get a new phone. Apple has to refund the woman her 799 euros and pay the court costs.
