No compensation after failed trial EPD
Software company Alert does not have to compensate the Jeroen Bosch Hospital for the failure of the EPD (Electronisch Patienten Dossier), an electronic patient filing system, that was introduced. That is the conclusion, reached by the court in Den Bosch.
The hospital demanded 8 million Euros in damages and the restitution of 1,1 million Euros in investments. It also terminated the contract with the software vendor, because they failed. At the Ruwaard van Putten Hospital unauthorized personnel gained access to electronic patient files.
According to the court, the hospital wrongfully terminated the contract and it has not been sufficiently clarified why Alert is deficient.
The Tweesteden Hospital in Tilburg, Bernhoven in Uden and the Atrium MC in Zuid-Limburg are also in conflict with Alert on the failure of the software project. The court will soon rule on the claim for compensation from the Tweesteden Hospital. In another proceeding Alert claims compensation from the four hospitals involved.
