Dutch security service tapped terrorist defense attorneys
The Security Service AIVD tapped the offices of Prakken d'Oliveira attorneys, Home Affairs Minister Ronald Plasterk has confirmed according to the lawyers.
't Parool writes that the attorneys who represent terrorism suspects, received this confirmation from the Minister in response to a complaint they filed. Plasterk confirmed part of their complaint.
Prakken d'Oliveira attorney Michiel Pestman said he was shocked. “In a democratic state, it is necessary that civilians can speak in confidence with their lawyers, even when they are subject in an AIVD investigation,” he said.
“We find that the AIVD does not respect the rights of lawyers,” Pestman continued. “The current rules on wiretapping fall short and we find that an amendment is necessary. Only a judge should be allowed to give permission on whether conversations of lawyers may be eavesdropped on.” Minister Plasterk agreed that part of the information the AIVD gathered had been used unjustly. “The AIVD acted irresponsibly. This regards communication that can be considered not relevant to any investigation by the AIVD. It is a violation of the rules and norms of decency.”
