More Dutch homeowners associations ban Airbnb rentals

An increasing number of homeowners associations have problems with Airbnb rentals, according to umbrella organization VvE Belang. A number of recent court rulings indicated that Airbnb rentals are not allowed without the permission of the homeowners association, and more and more are considering banning rentals to tourists, the organization said to BNR.

If the majority of a homeowners association is against an Airbnb rental, it is not allowed. This is because the divisional deed states that a home is a residential area, while rentals fall under businesses, according to the broadcaster. An increasing number of associations are making use of this clause.

If the homeowners association agrees, a rental is allowed within limits set by the association, Kees Oomen, CEO of VvE Belang, explained to the broadcaster. But many associations are not aware that they are able to stop such rentals. Associations are also allowed to fine people who illegally lease their homes.
