Dutch parliament votes to criminalize gay conversion therapy
Therapy practices meant to “cure” homosexuality are set to become punishable by law. A majority in the Tweede Kamer, the lower house of the Dutch parliament, voted in favor of a bill by D66 and the VVD that ensures this. In a debate last week, it became clear that the proposers had, with a few adjustments, persuaded some opponents to reconsider.
It became apparent that the topic is sensitive for conservative parties. They feared that even “pastoral conversations” within church circles about, for example, gender or sexual orientation could become punishable. The initiators clarified that it will only be a criminal offense to attempt to suppress or change someone’s sexual orientation in a “systematic” or “intrusive” manner.
Last week, BBB indicated in a debate that it would vote in favor of the bill after this clarification, bringing a majority within reach. In Tuesday’s vote, it became clear that NSC and CDA were also sufficiently reassured. As expected, SGP and ChristenUnie voted against it.
“Love does not need to be cured,” said D66 parliament member Wieke Paulusma. “With this law, we protect vulnerable people from harmful practices that endanger their health and safety. This is a choice for freedom, equality, and human dignity.”
VVD member Bente Becker is also enthusiastic. “In our country, you should be able to be who you are and love who you want. It is unacceptable for people to try to ‘cure’ you of your sexual orientation through prayer sessions or even abuse. With this bill, we ensure that such ‘conversion practices’ are punishable.”
The COC, an organization advocating for the rights of LGBTI+ people, welcomed the decision. “This is a major victory,” said a spokesperson. “Gender identity and sexual orientation cannot be changed. Claiming otherwise causes lifelong harm.”
The spokesperson said the COC has received overwhelmingly positive reactions from people who were subjected to therapies aimed at “curing” homosexuality. “They finally have recognition that there was nothing wrong with themselves, but with the people who subjected them to this.”
The COC hopes the ban will lead religious and other groups to stop treating homosexuality as a disease. “Because doing so destroys people.”
The bill is expected to be debated in the Senate in the coming months.
