Palestinian journalist challenges extradition to Austria over Hamas allegations
Palestinian journalist and activist Mustafa Ayyash, 33, is fighting his extradition to Austria. On Tuesday, his lawyer, Frederieke Dölle, urged the International Legal Assistance Chamber (IRK) of the Amsterdam District Court to deny the extradition request. A group of about 25 supporters carrying with Palestinian flags demonstrated outside the court during the hearing.
Ayyash was arrested at Schiphol Airport on Friday, September 21, upon request from the Austrian authorities. The country suspects him of being a member of Hamas, considered a terrorist organization in the European Union. Ayyash is also alleged to have financed Hamas. He said he had fled to Austria after he lost relatives due to a bombardment carried out by Israeli forces.
Ayyash told the court in Amsterdam that he traveled to the Netherlands to take legal action against Austria. “I came here to file a complaint against Austria for what they did to my family,” he said. He described how Austrian police raided his apartment at 7 a.m. “with weapons and violence,” while his wife was eight months pregnant. His lawyer, Frederieke Dölle, cited this as another reason to challenge extradition.
“He wishes to stress that the accusations against him are false,” said Dölle. The IRK only examines whether the conditions for extradition have been met, but it does not address the question of whether the man is guilty or not.
“As a well-known Palestinian journalist, he has long spoken out about the inhumane situation in Gaza. Israeli authorities have targeted him for years, and he is not the only journalist who fears for his safety. He believes these allegations stem from Israeli disinformation.” Dölle added that any contact he had with Hamas was purely in his role as a journalist.
His health condition was also cited as a reason to reject the extradition request. He is currently receiving treatment at a psychiatric facility in Vught for trauma related to war and persecution. According to various reports, he has engaged in self-harm, and may have attempted suicide while in care.
The court is expected to deliver its decision on November 11.
