Palestinian authorities urge Netherlands to shield ICC from U.S. sanctions

The Palestinian authorities, along with several allied nations, are calling on the Netherlands to protect the International Criminal Court (ICC) from potential U.S. sanctions. They suggest that, if necessary, the Netherlands should consider retaliatory measures against the United States. The Palestinian representative and the South African ambassador to the Netherlands emphasized that such countermeasures could be effective, given the Netherlands' role as the host country of the ICC.

South African Ambassador Vusi Madonsela and Palestinian representative Ammar Hijazi acknowledged the challenges in shielding the ICC from the "crippling" effects of potential U.S. sanctions, such as forced severance from American suppliers. However, they believe that major U.S. companies would be sensitive to countermeasures from significant trading partners like the Netherlands and the European Union.

They urge the Netherlands and Europe to assert themselves and collaborate with the global community to defend the ICC. Madonsela stated, "Together, they can and must make a stand with the rest of the world." The ambassadors emphasized that countermeasures are "entirely appropriate," noting that an attack on the ICC is an attack on its member states.

The U.S. has expressed strong opposition to the ICC's recent arrest warrants against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant. In response, the U.S. House of Representatives recently voted to advance a bill imposing sanctions on the ICC. Although the Senate blocked the bill, support for punitive measures against the court remains substantial, with new proposals under consideration.

Representatives from the Palestinian territories, South Africa, and eight other countries convened in The Hague to coordinate efforts to hold Israel accountable under international law. They argue that Israel is undermining the ICC and other international courts by disregarding their authority. Additionally, they criticize allies who, instead of supporting the court, have declared they will not arrest Netanyahu.
