Overijssel man wins court case over failed payment for gas and sausage rolls
A man from Overijssel will not have to pay the extra collection fees after failing to complete a payment for 56 euros worth of gasoline and two sausage rolls, a local court ruled. Because the station lost the case, it is responsible for 60 euros in legal costs.
The incident occurred in January 2024 when the man’s card transaction at a gas station failed. The next day, a bailiff contacted him demanding a total of 129.37 euros, including 56 euros for the fuel and snacks, plus 73.37 euros for collection costs, information fees, VAT, and interest.
The gas station argued that the man’s failure to pay was a "trot," a wrongful act, and repeatedly demanded that he cover the additional fees. After he paid only the original 56 euros, the station filed a lawsuit in May 2024.
The Almelo court reviewed the case over six months and concluded that the missed payment was accidental. The court ruled, “That he did not pay was accidental. There is therefore no question of a tort.” The gas station's theft claims were dismissed.
