Divorce at civil registration

State Secretary Teeven wants to make it possible for couples to get divorced without court intervention. Couples can turn to the registrar of civil registration. The new procedure will be faster and cheaper. Teeven has sent the proposed legislation to the House. Couples who are in mutual agreement and do not have minor children, can for the better part take care of the divorce themselves, without a lawyer. In the current situation the case is presented to a judge and a lawyer is mandatory. Fred_Teeven

The request has to be made by both and in person, and both parties need to agree there is no future left in their marriage. If the couple stand by their claim after fourteen days of reflection, the marriage is dissolved. The Netherlands registers about 34,000 divorces annually. In 14,000 cases no minors are involved, for whom a parenting plan must be drawn up, according to the Ministry of Security and Justice.
